Terms and Conditions of Electrical Emergency and Breakdown contracts
Formation of contract
The customer (means the person who accepts a quotation of the
seller for the sale of services) of these terms and conditions will be deemed
to have irrevocably accepted these terms and conditions. The seller is the business
providing the services to the customer, i.e. Taylors Electrical Testing.
If the customer objects to any of these terms and conditions such objections
must be made in writing and received by the seller at the address stated prior
to commencement of services, and it will not be binding on the seller unless
agreed in writing by an authorized representative of the seller. The sellers
failure to react to the terms contained in any communication from the customer
will not be deemed to be a waiver of these terms and conditions, which is so
accepted shall constitute a legally binding contract.
No variation of the contract shall be valid and binding unless the terms thereof have been agreed in writing by both the customer and the seller.
Definitions relating to the terms and conditions of contract
Domestic electrical wiring: The 240v electrical system within the property supplying electrical power from the consumer power unit to socket outlets, lighting outlets, switches etc. Limited to the hard wiring of the electrical system beyond the electricity supply meter.
Domestic electrical appliances: All electrical equipment not deemed part of the hard wiring within the property.
The seller: Taylors Electrical Testing
Material: All parts and material (fixtures fittings cables and accessories)
Cost of service agreement
The cost of the service is the total amount you pay as detailed in your options document.
Arrangement details
The arrangement minimum time is dependent upon the option of
service agreed.
Taylors Electrical reserves the right to cancel the agreement by giving you
at least 7 days notice at your last known address. If Taylors Electrical cancels
an arrangement Taylors Electrical will refund the option service agreement cost
providing no call out has occurred
Service agreement options are limited to one property per client as detailed
in service agreement package.
The maximum limit of labour supplied by Taylors Electrical Testing per year to any one agreement will be no more than 3 hours at a rate no higher than that of the standard JIB rate for electricians working in domestic/commercial properties at the time of signing the agreement.
If a call out is made for any reason clearly stated as not in the service agreement then a call out charge and labour charge will be applied ( minimum charge per call out 1 hour labour plus call out charge).
If Taylors Electrical cannot continue to honor the agreement due to bankruptcy or any other cause resulting in the termination of business, all yearly service agreement contracts will be null and void and no claim for loss will be made against Taylors Electrical Testing or any associate at the time of termination.
If no claim is made on a service agreement in one year a free safety inspection will be available to the client upon request.
In relation to the service agreements Taylors Electrical will only omit the cost of the first hours labour of any one call out. Any labour time after that is subject to charge.
The service agreement does not cover the day-to-day maintenance of the domestic electrical wiring at your property that you should do. This includes replacing light bulbs, decorative fittings, or fuseable links or the replacement of items within your property that will gradually wear out over a period of time.
The service agreements are not insurance policies.
Details of service agreement
In the event of a total failure of the electrical wiring in your property not due to failure of external public/utility services, A qualified engineer will be with you within 2 hours of notification. If we fail to achieve this we will refund the cost of your service agreement option limited to a maximum of one years refunded payment.
Exclusions
The following items are excluded from the service agreement
· Any loss or damage arising from circumstances known
to you before the service began
· Any loss or damage arising from the interruption of the public utility
services
· The resetting of breakers or switches, where no repair is needed and
can be reset by you.
· The replacement of bulbs, fuse wire or any other routine electrical
tasks
· Any adjustment to timing or temperature controls.
· The replacement of transformers controlling the voltage to a single
or multiple low voltage fittings.
· The repair/replacement/disconnection work to the integral part of any
electrical device or any electronic devices, including temperature sensors and
pir/light sensors.
· Any electrical system that is not 240v rated.
· Any item that is not part of the domestic electrical wiring
· Any fixtures including wiring and earthing where its replacement is
only due to a change legislation or health and safety guidelines.
· Any equipment that has not been installed, serviced or maintained in
accordance with statutory regulations, British standards or manufactures instructions.
· Any electrics which are not permanent and/or situated outside the property,
Such as christmas lights
· Control wiring of burglar alarms, fire alarms, telephone wiring, doorbells,
electrical garage door systems.
· Immersion heater with exception of wiring to.
· Wiring to satellite dishes, radio and television their fittings and
masts.
· Electric supplies which are connected to a pump to a swimming pool,
pond, fish tank or any other water feature whether inside or outside the property.
· Domestic electrical appliances.
Taylors Electrical will not be liable for the following:
· Repair or replacement costs if Taylors Electrical is unable to repair
the domestic electrical wiring due to its age or poor condition.
· The like for like replacement of wall sockets, switches or fittings
necessary in repairing or remedying a breakdown and/or failure of the domestic
electrical wiring.
· Any defect damage or breakdown caused through malicious or willful
action, negligence, misuse or third party interference including any attempted
repair or modification to the domestic electrical wiring which does not comply
with recognized standards.
· Any loss in the event of damage occurring where the property has remained
unoccupied for 60 or more consecutive days.
· Any part of the wiring which is to difficult to access safely, which
is impossible or impractical to maintain because of its position.
· Any costs above the limits of the service agreement
· Replacement costs of domestic electrical wiring which needs to be replaced
as a consequence of natural wear and tear or gradual deterioration.
· Cost incurred where you have been advised of the need to carry out
permanent repair work to avoid repetitive situations leading to a breakdown
or failure.
· Any defect, loss or damage occasioned by fire, lighting, explosion,
storm, tempest, impact, or other extraneous causes.
· Any material costs
· Any defect loss or damage arising as a consequence of war, invasion,
act of foreign enemies, terrorism, hostilities, (whether war be declared or
not) civil war, rebellion, revolution, insurrection, military or unsurped power,
riot or civil commotion ionizing radiation or contamination by radioactivity
from any nuclear fuelor from any nuclear waste from combustion of nuclear fuel,
the radioactive toxic explosive or other hazardous properties of any explosive
nuclear assembly or nuclear component thereof.
· Any cost due to delays in our contractors response time or any delays
by our suppliers or their agents in obtaining parts that are not immediately
available.
General conditions
Taylors Electrical reserves the right to refuse any individual contract.
Pricing
Invoiced prices will be based upon relevant prices in
effect at the time an order is received from the customer. Any prices quoted
by the seller are subject to change and valid as specified on the quotation.
A quotation is based on customer specification and may be subject to change
in the event of any deviations and is valid for 28 days unless otherwise stated
on the quotation, which is agreed by an authorized representative of the seller.
Thereafter the seller reserves the right to review the tender figure.
Payment shall be made no later than 30 days after date of invoice. The business reserves the right to charge statutory interest at the reference rate as set by the Bank of England, plus the 8%to give an overall interest rate per month in accordance with guidelines and legislation for the late payments of commercial debts(interest)act 1998 and the late payments of commercial debts regulations 2002under the European directive2000/35/EC on overdue amounts both before and after judgment. The customer will pay all of the sellers costs and expenses( including reasonable legal fees)to enforce or preserve sellers rights hereunder whether or not an action is commenced.
Where the seller supplies services to the customer in accordance with customer specification, any alteration or addition shall be subject to an extra charge, and the customer shall indemnify the seller against all damages, penalties, costs and expenses to which it may become liable through the infringements of third party rights.
Any costs incurred to the seller in respect to customers restrictions which the seller has not been notified of in adequate time will be subject to charge.
Material
All material/products used as requested by the customer
will remain the property of Taylors electrical testing,(the seller) until final
payment is received in full. Any charges incurred by late payments on products
purchased by the seller will be forwarded to the customer and payment is to
be received in line with the sellers terms and conditions as stated. All non
returnable material/products purchased by the seller for the customer will be
liable for reimbursement by the customer even if the customer no longer requires
the purchase.
The risk in the material/property supplied by the seller shall pass to the customer
as soon as they are in the Customers possession. When payment for the products
is overdue or the customer suffers distress or execution to be levied against
its effects, makes an arrangement or composition with creditors or being a corporate
body, enters in to liquidation or has an administrator or receiver appointed
for the whole or any part of the undertaking or, being an individual, has a
receiving order r bankruptcy made against them then:
If the customer remains in possession of the products, whether
or not the customer has sold them, the seller shall be entitled to recover the
products from the customer. The seller for the purpose of recovery of its products
may enter upon any premises where they are stored or installed and repossess
the same.
Liability for loss or damage passes to the customer on receipt of the products.
Inspection and Acceptance
Products and services will be conclusively deemed accepted
by the customer unless the customer has sent a notice of rejection within a
30-day period.
Contingencies
The seller will not be liable for any delay in performance
or for non performance in whole or part caused by the occurrences of any contingency
beyond the control either if seller or sellers suppliers, including but not
limited to war, sabotage, insurrection, riot or other civil act of disobedience,
act of a public enemy, act of government or any government of any agency or
subdivision thereof affecting the terms of this contract or otherwise, judicial
action, labour dispute, accident, fire, explosion, flood, storm, or other act
of god, shortage of labour, fuel, raw materials, tools, dies or equipment, or
technical or yield failure.
Warranties
The seller offers 1 months warranty on workmanship. All
products are subject to their individual warranties as stated by companies supplying
these products. The seller is not to be held responsible for faulty goods supplied
by such companies. The seller can at its own discretion charge for extra labour
in the replacing of faulty equipment supplied by manufactures if it feels necessary
to do so. The seller will not be held liable for cost due to replacement or
refund of any products that are non returnable or non replaceable.
Limitation of liability
The seller shall not be liable to the customer or any
other person for indirect, special, incidental, consequential, punitive, or
exemplary damages arising out of or in connection with this transaction or any
acts or omissions associated therewith relating to the sale or use of any items
or services furnished, whether such claim is based on breach of warranty, contract,
tort or other legal theory, and regardless of the causes of such loss or damages
or whether any other remedy provided herein fails.
Sellers Rights
The seller has the right to cancel a contract if the customer
breaches any of the terms and conditions in this contract.
Access
The customer shall grant Taylors Electrical Testing access
to the installation address at reasonable times, for the purpose of undertaking
the specified work.
Additional
The Visual inspection offered does in no way guarantee
the safety of an electrical installation and is only to be used as a guide.
All offers are subjected to change at the discretion of the
seller
In the signing of this agreement the customer accepts all of the terms and conditions
and are legally committed to them, subject to the laws of Great Britain
The customer prior to an electrical test and inspection must disconnect all appliances/utility’s from the electrical installation as far as is reasonably practical. Any equipment that is deemed not safe for the customer to disconnect, Taylors Electrical must be made aware of prior to commencement of tests. Taylors Electrical will not be held liable for damages resulting from tests and inspections if the customer has not followed the above procedure.
